My honest answer if I was presiding over this would be a little rough justice. I feel that you should not get better than a simple replacement. The seller should have looked at all the wheels before making his claim all look like new. The penalty for not looking should be 135.00 the cost to replace the damaged. (you should get it back and in court that's my order). Buyer gets exactly what was advertised a new lock for 135.00 go buy it. I would allow you to keep the old one and new one for your troubles unless the seller were willing to pay to get the one back. ( I don't think he wants one.).. Judgment buyer 135.00.....

Can we all just get along now..

My vote is that the seller failed to see that one wheel had a scuff. It were me, especially if I sold on EBAY with seller ratings, I'd suck up my mistake and I'd order the buyer a new ring and have it shipped to the buyer. That's how most of us expect retailers to treat us, I certainly do.

My opinion? The seller is liable because of not fully vetting the merchandise being sold. If I sell something and the customer doesn't get what they paid for, I usually eat the cost right off the bat without discussion. But that is just me. Better to take the loss than to have something drag on that causes issues with either Paypal OR Ebay.

Flip Side? I believe the receiver of the rims went off a little too early filing a claim with Paypal before allowing the seller to make a good faith effort to resolve the issue. When claims are filed with Paypal, they take the money and even if the claim is canceled by the customer, they STILL hold the money until they are sure that the issue is resolved. This can take anywhere from a couple of days up to a couple of weeks that the seller is now out the $400 being held.

In my opinion, neither party handled this correctly and as a result should meet in the middle somewhere. At most I would replace the ring with a new $135 unit AT MOST, ONCE Paypal has refunded the money being held for the claim.

Send him a new ring and be done with it. Of course if you can afford to buy a Roush Raptor to pull a show car you can afford it yourself expecially with the great deal that you got on the wheels in the first place. Just my opinion.

1) is the money available and is it needed right away by the seller? (creates a time for the poll)

2) Do both parties agree to drop there dispute and have it settled here , on the p.. on the Forum?

3) The poll will be binding and both parties agree to follow the highest percentage decided.

4) Neither party can vote in the poll...

5) Whats the poll options..

The seller agreed to split the cost. The buyer did not request photos of all rims. I would have if a scratch is such a big deal. Unfortunately, there is no proof that run was not scratched in transit. The seller didn't provide pics and the buyer didn't request them. They should split the cost.

1. PayPal has reversed the charge against me, so I'm good with the 7 days max suggested by the purchaser.

2. I agree to fully settle the dispute on FRF

3. I agree, IF, the maximum payout is the $155.34 cost of repairing the wheel ring.

4. Okay

5. I would suggest;
A. $155.34 to repair the wheel
B. $135.00 to replace the ring
C. Split the cost of A
D. No further money exchanged, call it even
