How are you not at the dealer raising hell and coughing on everyone? I’d be so pissed. Not proud, but I almost got into a fistfight with a service manager when they put 70 miles on a 2012 CTS-V I had years ago. They changed the radio to a rap station, reclined the seat, etc. when the repair didn’t require more than a mile or two drive tops. They clearly went on a long ass joyride through DFW.

Have you worked your way up the chain of command? Service manager, GM, owner, etc. I know several dealership owners and it is extremely rare that they will respond directly to a customer. A couple of them rarely go into the dealerships. Don't blow your leverage just yet. If I were in your shoes I would start with the service manager and if possible the GM in a joint meeting. Based on that outcome there is likely a VP and a President between the GM and owner.

Not sure how much of a hassle it will be for you, but you might want to go there in person before posting it. The GM/Owner might have a good reason for not returning your call. (Out of town, COVID-19 quarantine, etc). Once you know for sure they plan to do nothing, then move to plan B. Post the video, call local TV station, lawyer ...

I’m sure the GM/owner has a lot on their plate right now. I would be hesitant to post anything and slamming the dealership without a conversation first.

You guys called it! He had a good reason not to respond but we are now in contact. I will be back in town tomorrow to go meet in person.

I am doubtful that we will come to a satisfactory resolution but I’m willing to give it a shot.

Subscribed! I don't know how service could justify driving a customers truck home. They don't need to drive it home to see if it's fixed.

Just in case the civil matter is weak, have you checked the state code? you have to do some digging but let’s just say i’m ‘familiar with’ a state code entitled ‘unlawful use of an animal, aircraft, vehicle or boat’ which sounds a little Arkansas/rednecky, but, it’s a class 6 felony, and very easy to make a conviction on thanks to the courts. We’ll say that I’ve been successful at leveraging the threat of this warrant being issued to ensure someone wasn’t screwed with for --hyptothetically-- having a firearm in their vehicle on private property against employment policy.

Your state may, or may not have a similar statute making it unlawful for someone to abscond with your vehicle. But wait you say, Mechanic’s lien! right, but you have video and presumably any “test driving” pursuant to an actual repair is far less than 400 miles and at some point the use of the vehicle transgresses from legitimate repair to, well... let’s call it what it is - larceny.

I’ve found in life that the possibility of losing one’s freedom and the ensuing stigma of a felony rap is a great motivator in making things right. Hopefully you do as well, OP.

Certainly a motivator for getting a proper resolution

I'm very far from a lawyer, but there is also this. In PA there is a crime called "unauthorized use of a motor vehicle." It is a 2nd degree misdemeanor. The problem here is that the service paper you signed authorized them to use the vehicle. Not for 400 miles to drive to and from work everyday. But to test it out to see if the problem was fixed. Take it for what it's worth.
