New 19 Was sold to me by dealer and has been repainted

So I posted the thread about my 19 not starting ended up being a blown fuse they traced it to harness issue. The they told me when the truck had 6 miles on it the dealer that they did the trade from had removed and repainted the front fender and that is were the wiring issue was. First off I would have never bought this truck knowing it was repainted or had a fender removed. Secondly should this have not been disclosed upon purchase of a new vehicle?

I am waiting to hear back from the store GM but wanted to know what my legal rights are and how I should proceed. I love the truck but I also know resale will be effected down the road and obviously it has already given me problems. Should I just insist they find another truck and replace this one?

Not sure what to do here, part of the issue also is the weather has been rainy and snowing and windy since I purchased the truck so I have not been able to give it a proper detail if so I would have seen that the fender was off. I had not even really inspected anything under the hood but you can clearly see the witness marks on the fender bolts and OASIS report also shows the fender was removed and repainted.

The obvious path here is to contact an actual lawyer in your state, not seek legal advise from random internet strangers

It does not have to be disclosed where I live. Many new vehicles are repaired without disclosure. I have a very good friend who owned several body shops and the volume he did for new dealers was staggering. From small dings to full fender repair and up.

I think it may be specific to the state you're in also. New just means it wasn't titled previously. It doesn't mean it hasn't been damaged previously. Always test drive a vehicle and look over it thoroughly even if it's new.

Ehh... I don't know. Yes, I would contact the dealer you bought it from and ask for a price adjustment based on the value impact of the documented fender work. If it didn't work out... I think I would just chalk it up to a learning experience. I assume you looked it over before finalizing the sale. The paint must match well.

I know it sucks having the feeling that your new truck isn't completely new, but dealing with lawyers and such for essentially a few hundred... maybe a thousand dollars in perceived vehicle value is more headache than its worth to me.

Asking for the OASIS report on an unsold new vehicle probably isn't on everyone's radar, but now it is.

I don’t know the exact numbers but my buddy who owns a body shop told me once about how dealers can do up to a certain percentage of the cars value in repairs without having to disclose it. You can make a fuss and the dealer may send something your way to try and appease you, but the truck will continue to be yours as is.

I had some minor body work done to my '18 (with my full knowledge) and the body shop told me the same thing. Something like under $2k worth of damage did not need to be disclosed and they said it was fairly common. They had a GT350 there getting a new bumper due to shipping damage and said that would never be disclosed either.

I think it’s 5% of MSRP prices

True. Mercedes and BMW fix damage during shipping at the port before they are released to dealers. They don’t disclose paintwork.
