Infinity I wouldn't worry about buying used. Check to see if the shocks are leaking, check gap between the cab and bed to see if its off at all (bent frame indication), look at the fender mounting hardware to see if it was removed (sign of either replacement or repair), check to see if the front seats rock back and forth at all.

I bought mine used and so far it has been good to me. I have had minor issues with it that I would not blame on the previous owner. If I had to do it over again I wouldn't change a thing.

Used is ok if you are getting a killer deal. But these things hold value well. I wanted used, but new was only a grand or two more. I'd talk to an ebay dealer about a new one. Some of em will deal with you.

Is this something that happens after hard off roading or a in general type problem.

I know on mine (2011 SCREW) and a couple others the bushings in the seats wore out prematurely and that's when the rocking started. Not sure if it was from offroading or just a bad part. It was still fixed under warranty as was my seat bottoms for having wear where the plastic that covers the seat belt touches the leather.
