They can already do this. You can use your app. What they are doing is making it available to law enforcement to use without a warrant

My wife recently read an article about AT&T keeping years of phone records (sometimes to include voice calls and text content) and turning them over to the feds with very low effort. She said she was not concerned because she doesn't do anything wrong. While I agree that I have nothing to hide from a legal perspective, it should concern everyone that this is just the beginning, and your general privacy is currently in jeopardy, if not already nonexistent.
